Terms & Conditions — My Movement Medicine

Who we are: My Movement Medicine (“we”, “us”, “our”) provides face-to-face, hybrid and online exercise sessions, one-to-one exercise physiology, and related digital resources.

These Terms & Conditions (“Terms”) form the contract between you and My Movement Medicine when you book, purchase, attend, or access our services or content.

1) Key Definitions

  • Session: Any exercise class (in-person, hybrid, or online), one-to-one, workshop, course, or event we run.

  • Digital Content: Any recordings, downloads, PDFs, plans, or online materials we make available.

  • Class Pack / Membership: Any bundle, pass, subscription, or package granting access to Sessions or content.

  • Venue: Any physical location we use to host Sessions.

2) Eligibility, Health & Medical Clearance

  1. Pre-participation: Before attending any Session, you must complete our online introduction programme, health questionnaire (disclosing any new, past, and ongoing injuries/long-term conditions in writing), and sign the informed consent/waiver. Please do not participate until these are completed and accepted.

  2. Age: You confirm you are 18+. Under-18s or vulnerable adults may attend only with prior written parent/guardian consent and our approval.

  3. Changes to your health: If your health status changes (e.g., new or changed medication, hospital admission/discharge, new diagnosis), tell the instructor before your next Session. We may require a new questionnaire and/or medical clearance.

  4. Clinical alignment: Our Sessions follow national cardiac rehabilitation guidance (e.g., BACPR) to minimise risk and improve safety and effectiveness.

  5. Exercise within capacity: Work within your prescribed training zone (typically 40–70% of your calculated target heart-rate range unless advised otherwise) and avoid activities that feel excessively “heavy.” Warm up and cool down as directed.

  6. Symptoms or injury: If you experience chest pain, unusual breathlessness, dizziness, palpitations, new pain, or any injury, stop immediately and inform the instructor so we can modify or stop the Session.

  7. Medication: Bring any prescribed emergency medication (e.g., GTN spray) to Sessions and ensure hydration and suitable clothing/footwear.

  8. Right to refuse/suspend: We may refuse or suspend participation if we believe it is unsafe for you or others, or until appropriate medical clearance is received.

3) Booking, Prices & Payment

  1. Booking & confirmation: Bookings are confirmed once payment is received and a confirmation email is issued.

  2. Prices: Prices are shown at checkout and may change; the price at the point of purchase applies.

  3. Payment methods: We accept the methods listed at checkout. Third-party platform terms (e.g., Stripe, PayPal, booking apps) also apply.

4) Cancellations, Transfers & Refunds

(Edit the time windows below to your preference; these are sensible defaults.)

  1. Single Sessions (group classes): Cancel ≥24 hours before the start for a credit or transfer. Cancellations <24 hours or no-shows are non-refundable and non-transferable.

  2. One-to-ones: Cancel ≥24 hours before the appointment for a rebook/credit. Cancellations <24 hours are chargeable.

  3. Courses/workshops: Cancel ≥7 days before the start for a full refund/credit; otherwise no refund (you may nominate a suitable substitute).

  4. Our changes: We may reschedule or cancel (e.g., illness, venue issues, safety). If we cancel and no reasonable alternative is offered, we will refund or credit affected bookings.

  5. Consumer cooling-off: For Sessions on a specific date, the 14-day cooling-off right does not apply. For Digital Content supplied for immediate access, you agree access starts immediately and you waive the 14-day cancellation right.

5) Class Packs & Memberships

  1. Validity: Each pack/membership states a validity period (e.g., use within 8–12 weeks of first booking). Unused credits expire after the validity period.

  2. Non-transferable: Packs/memberships are personal, non-transferable, and non-refundable except where required by law.

  3. Freezes: Temporary freezes may be allowed for significant medical reasons with evidence; an admin fee may apply—please email us.

6) Lateness & Attendance

  • To protect your safety, late arrivals who miss the warm-up may be refused entry.

  • In group Sessions, participants will be at different stages of recovery and fitness; please focus on your own level and avoid comparing intensities with others.

  • For online Sessions, join a few minutes early to check audio/video and any heart-rate devices.

7) Online Sessions, Recording & Catch-Up Access

  1. Notice of recording: Some Sessions may be recorded to provide time-limited catch-up access for registered participants and for instructor quality/training.

  2. Minimising attendee capture: We aim to film the instructor and avoid filming attendees.

    • In-person: a no-film area will be available; please tell the instructor if you need additional adjustments.

    • Online: keep your camera/mic off if you do not wish to appear; you may use a non-identifying display name.

  3. Access & sharing: Recordings are stored securely and shared on a variety of outlets. Do not download, copy, or re-share any recording or screenshots.

  4. Retention & deletion: Catch-up recordings are typically available online. You can request deletion of a segment where you are identifiable by emailing us.

  5. No public/marketing use without consent: We will not publish recordings or use them for marketing/public purposes without your separate, explicit, opt-in consent (see Section 11).

8) Heart-Rate Monitoring & Wearables

  1. We may use heart-rate monitoring (e.g., Polar) to help guide intensity and provide feedback.

  2. Heart-rate zones are guidance, not a medical diagnosis. Continue to exercise within your capacity and stop if unwell.

  3. Where heart-rate data is linked to you, it may constitute health data. We process it in line with our Privacy Notice and applicable data protection law.

9) Safety Rules, Code of Conduct & Community

  • During Sessions: follow instructor guidance, venue rules and equipment instructions. Report hazards/faults immediately.

  • Respectful community: be considerate of others’ progress and privacy in-person and online.

  • WhatsApp & support groups: keep messages respectful and relevant to rehabilitation; no advertising without admin consent.

  • We may remove access or ask anyone to leave for inappropriate or unsafe behaviour, without refund.

10) Personal Belongings

Personal items are your responsibility. We are not liable for loss, theft, or damage to personal property at the Venue or during online participation.

11) Photography, Video & Marketing (Separate Consent)

  1. We sometimes capture photos/video for promotional use (e.g., website, social media, print). If you are identifiable, we will only use such media with your separate, explicit, opt-in consent. Consent is voluntary, not a condition of service, and can be withdrawn at any time by emailing mymovementmedicine@gmail.com. Withdrawal stops future use; we will take reasonable steps to remove online content where practicable.

  2. Children/vulnerable adults: Where applicable, we will seek consent from a parent/guardian or appropriate representative.

12) Digital Content & Exercise Videos

  1. Use safely: Before using any exercise video or online programme, please watch/read the relevant introduction and safety guidance.

  2. Support if needed: If you have a long-term condition or a past medical event/injury, consider having support nearby at home in case assistance is required.

  3. Licence & sharing: Digital Content is for your personal use only and must not be copied, shared, or redistributed.

13) Privacy & Data Protection (Summary)

  1. Controller: My Movement Medicine is the data controller for personal data we collect. See our Privacy Notice for full details.

  2. What we collect: Contact details, booking/attendance data, health questionnaires, training notes, and—if used—heart-rate metrics and recordings. Some data may be special-category health data.

  3. Purposes & lawful bases:

    • Service delivery & safety (including private catch-up recording, where used): legitimate interests (we minimise attendee capture and offer opt-out routes).

    • Marketing/public images/recordings: explicit consent.

  4. Your rights: Under UK GDPR you can request access, correction, deletion, objection/restriction, and withdraw consent at any time.

  5. Security & retention: We keep data secure, retain only as long as necessary, and may use trusted processors (e.g., booking, payments, HRM platforms). We never sell your data. Contact: mymovementmedicine@gmail.com.

14) Intellectual Property

All materials, programmes, Digital Content and recordings are owned by us (or our licensors). You receive a personal, non-transferable licence for your own use. No copying, sharing, resale, or commercial use without our written permission.

15) Liability

  1. Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be limited by law.

  2. Subject to your statutory rights and where we have exercised reasonable care and skill, we are not liable for:

    • any indirect or consequential loss;

    • loss arising from your failure to follow medical advice or safety instructions;

    • issues outside our reasonable control (see Section 16).

  3. You acknowledge that exercise carries inherent risk. By participating, you accept responsibility for exercising within your capacity and notifying us of any concerns.

16) Events Outside Our Control (Force Majeure)

We are not responsible for delays or failure to perform caused by events beyond our reasonable control (e.g., extreme weather, strikes, power/internet outages, public health restrictions). We’ll try to offer reasonable alternatives (e.g., rescheduling, online delivery).

17) Complaints

We aim to resolve issues quickly and fairly. Please email mymovementmedicine@gmail.com with details. We’ll acknowledge within 2–5 working days and aim to respond fully within 10 working days.

18) Changes to Services & to These Terms

We may update classes, schedules, prices, or these Terms from time to time. We’ll post updates on our website and/or notify you where appropriate. Changes won’t affect bookings already made unless required for safety or by law.

19) Governing Law

These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, without affecting your statutory consumer rights.
